Agreement

These Terms govern your access to and use of matkowsky.com and its AI interface. By accessing or using the site or AI interface, you agree to be bound by these Terms. The Privacy Notice explains how information is processed and should be read together with these Terms. If you do not agree to these Terms, do not access or use the site or AI interface.

AI-generated information

The conversational interface uses artificial intelligence. AI-generated responses may contain errors, omissions, or outdated information and are not Jonathan Matkowsky's personal review of your facts. You should independently evaluate information generated by the AI interface before relying on it.

General information; not legal advice

The site and AI interface provide general informational material. They do not provide individualized legal advice or establish that a particular proceeding, strategy, remedy, or result is appropriate for your circumstances.

No attorney-client relationship

Using the site or AI interface, receiving an AI response, or sending an inquiry does not create an attorney-client relationship. Representation begins only if Jonathan and the prospective client enter into a written engagement agreement. Do not assume that a conflict has been cleared or a matter accepted unless Jonathan confirms it.

Confidential and personal information

The public AI interface is not a confidential communication channel. Do not submit personal data, confidential or privileged communications, credentials, proprietary information, strategy, evidence, or case documents through it. For a potential engagement or conflict check, contact Jonathan outside the public AI interface at [email protected] and limit the initial communication to information reasonably necessary for conflicts and intake.

Attorney representation and domain proceedings

A person need not be an attorney to serve as a representative in the domain-name administrative proceedings described on this site. Jonathan handles accepted matters as an attorney and is admitted to practice in New York and Washington State. No result is guaranteed, and prior results do not guarantee a similar outcome. UDRP remedies are generally limited to transfer or cancellation of a disputed domain name; they do not include damages or general injunctive relief.

New York Statement of Client's Rights

Jonathan is admitted to practice in New York. The New York courts publish a Statement of Client's Rights.

Acceptable use

You may use the site for lawful informational purposes related to the services described here. You may not attack, disrupt, overload, scrape, systematically extract, probe, reverse engineer, or interfere with the site or AI interface; circumvent security measures, rate limits, or usage controls; attempt to obtain system prompts, hidden instructions, credentials, configuration, or nonpublic source material; or use the AI interface as a general-purpose AI proxy. You are responsible for information you submit and for having the rights and authority necessary to submit it.

Third-party resources

The site may link to published decisions, provider materials, professional profiles, or other third-party resources. Those resources are maintained by their respective publishers, and links do not imply control of or responsibility for third-party content.

Availability

The site, AI functionality, content, and features may be changed, limited, suspended, or discontinued at any time, including for maintenance, security, abuse prevention, legal, or operational reasons. Continuous or error-free availability is not promised.

Intellectual property

Except for identified third-party materials, trademarks, and other third-party content, original materials on this site are protected by applicable intellectual-property law. Ordinary viewing and evaluation of Jonathan's services is permitted. Systematic copying, scraping, republication, or commercial exploitation is not authorized except as permitted by law.

Disclaimer of warranties

To the fullest extent permitted by applicable law, the site, its content, and AI-generated responses are provided “as is” and “as available,” without warranties of any kind, express or implied. No representation or warranty is made that content or AI output will be complete, current, accurate, error-free, secure, or suitable for a particular purpose. Nothing in these Terms limits professional obligations that apply after an attorney-client relationship is formed.

Limitation of liability

To the fullest extent permitted by applicable law, Jonathan Matkowsky will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or reliance on the site or AI-generated information, inability to use the site, third-party services, or unauthorized use. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited or professional responsibility arising from an attorney-client relationship.

Governing law and forum

To the fullest extent permitted by applicable law, these Terms and disputes arising out of or relating to use of the site or AI interface are governed by the laws of the State of New York, without regard to conflict-of-laws principles. You consent to exclusive jurisdiction and venue in the state courts located in New York County, New York, or, where federal subject-matter jurisdiction exists, the United States District Court for the Southern District of New York. This provision does not govern an attorney-client engagement, which is addressed separately in the applicable engagement agreement.

Changes to these Terms

These Terms may be revised from time to time. If a change is material, notice will be provided through the site or by other appropriate means. The current version and last-updated date will be posted on the site. Continued use after the effective date of revised Terms constitutes acceptance of them to the extent permitted by applicable law.

Severability; waiver

If a provision of these Terms is held unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law. Failure to enforce a provision does not waive the right to enforce it later.
